Online Gambling Laws
Online gambling has grown exponentially in recent years. This has not only been due to the availability of the internet, but also the increasing use of smartphones. However, the industry is still faced with some concerns. Those include the risk of children using the site, the possibility of fraud, and whether the payouts are fair. Several measures have been implemented to address these issues. In the U.S., the Online Gambling Regulation Act (OGRA) is just one.
The OGRA has a number of provisions, including: a licensing scheme; a consumer protections law; a criminal investigation process; and a monitoring system. Each state has its own unique set of laws. Some states have banned certain forms of online gambling, while others have passed specific statutes relating to the matter.
A number of federal statutes have been implicated by illegal Internet gambling. These include: 31 U.S.C. 5362, which outlines unlawful Internet gambling; 18 U.S.C. 1955, which governs betting and lotteries; and 18 U.S.C. 1956, which provides for laundering for international purposes.
Another notable law is the Travel Act, which imposes criminal penalties on players who engage in Internet casinos and other facilities located in states where the law is in effect. It is possible for a player to be engaged in the gambling biz while traveling in the continental United States, but such activity is unlikely.
One of the most interesting aspects of the online gambling market is that it covers almost the entire globe. Countries in North America, Europe, Asia, and the Middle East have a wide variety of gambling sites available. Most of these websites offer a mobile version of their site, allowing users to access their games from wherever they happen to be.
Another notable example is the CRS Report RS21984 which, surprisingly enough, contains citations to a number of state statutes pertaining to the Internet. Of course, a good rule of thumb is that the best way to find out what the state or federal laws are is to check with your local authorities.
Fortunately, the state of California has taken steps to address this issue, requiring that all Internet gaming sites be certified as licensed. In addition, the state has a Gambling Supervision Commission that is tasked with regulating the industry and keeping consumers safe. Several licensing bodies in the state enact strict codes of conduct for licensees.
The Internet has been used for online gambling for a long time, but it only became mainstream in the mid-1990s. The first venue for legal Internet gambling was Liechtenstein’s International Lottery. Since then, the online gaming industry has gained a tremendous amount of traction, particularly in the U.S. There is a large range of websites for gamblers, from poker rooms to sports betting sites.
Although there is no legal limit on the amount of money that can be spent on gambling, it is illegal to engage in online gambling in the state of New Jersey.
